OFCCP Issues Contract Requirement Exemptions in light of Hurricane Devastation

The U.S. Department of Labor’s (DOL) Office of Federal Contract Compliance Programs (OFCCP) has issued temporary contracting requirement exemptions for new contracts in light of Hurricanes Michael and Florence.

The exemptions state that new federal contracts will be exempt from having to develop written affirmative action programs under Executive Order 11246; The Vietnam Era Veterans Readjustment Assistance Act; and Section 503 of the Rehabilitation act of 1973.

For Hurricane Florence, the exemption and waiver period applies for a three-month period, running from September 17, 2018, to December 17, 2018.

The exemption and waiver period for Hurricane Michael applies from October 11, 2018, to January 11, 2019.

Both exemptions are subject to extension “should special circumstances in the national interest so require.”

If you are unsure if your Federal contract is exempt, the OFCCP issued a National Interest Exemption Memorandum to all federal contracting agencies notifying them of the memo.

This isn’t the first disaster relief to be issued in the aftermath of Hurricanes Florence and Michael. The IRS has issued WOTC deadline extensions to affected counties in Florida, Georgia, North Carolina, South Carolina, and Virginia.
